In accordance with the provisions of the current regulations on Personal Data Protection, we inform you that your data will be incorporated into the processing system owned by Hotels & Resorts Blue Sea Management, S.L. (hereinafter, “HRBS”), with Tax ID B-57817215, registered address at Gremi des Fusters, 33 office 223, 07009, Palma de Mallorca (Illes Balears), registered in the Commercial Registry of Mallorca in volume 2544, Folio 168, Sheet PM-672291, for the purposes of:

(i) Managing your reservation and the provision of the contracted accommodation service, including payment processing (where applicable) and the management of your requests and preferences, as well as handling your contact requests with HRBS through the channels provided for such purpose; all of which is necessary for the execution of the service provision contract that binds us to our customers;

(ii) Managing the completion of surveys and/or evaluations regarding the quality of the services provided by HRBS and/or your perception of HRBS as a company/Hotel Group, based on our legitimate interest in assessing your satisfaction, understanding your expectations, and improving the quality of our products and services;

(iii) Managing the sending of personalized commercial communications by electronic means, with information related to products, services, promotions, offers, events, or news from the BLUESEA Group, relevant to our customers; all of this solely and exclusively in accordance with (a) the data provided by them and (b) their stay and experiences with the BLUESEA Group. No automated decisions will be made based on such information.
In this latter case, we consider that we have a legitimate interest in knowing our customers’ preferences in order to offer services that best meet their needs and desires.

Without prejudice to the above, users who wish to unsubscribe from receiving commercial communications may do so at any time and at no cost by sending an email to the following address: dpo@blueseahotels.es, following the instructions specified below, as well as through the indications that will be included in each commercial communication.

The legal basis for processing customer data for this purpose is the consent granted by checking the indicated box.
The personal data provided will be kept during the contractual relationship with our customers, as well as for the time necessary to fulfill the purposes indicated above or any applicable legal obligations.

Regarding the data used for sending commercial communications, they will be kept as long as customers do not revoke or object to the consent granted. However, if you withdraw your consent, this will not affect the legality of the processing carried out beforehand. The Customer’s data may be communicated to: Companies owned or belonging to the HRBS business group, listed at the end of this Policy, exclusively for internal administrative purposes and/or for the purposes indicated above, with processing being carried out by said companies, in all cases, under the same terms, conditions, and guarantees set out in this Policy; HRBS suppliers or hotel operators necessary for the proper fulfillment of legal obligations and/or the purposes indicated above; HRBS Group partners and collaborating companies for the fulfillment of the purposes indicated above and/or, if authorized, for the sending of commercial communications; and Public Administrations, in cases provided for by law.

The Customer:
Guarantees that they are of legal age or legally emancipated where applicable, fully capable, and that the data they provide to HRBS is true, accurate, complete, and up to date. For these purposes, the Customer is responsible for the accuracy of all the data they provide.
Guarantees that they have informed any third parties whose data they provide, where applicable, of the aspects contained in this document. Likewise, the Customer guarantees that they have obtained their authorization to provide their data to HRBS for the purposes indicated.
They will be responsible for any false or inaccurate information they provide and for any direct or indirect damages caused to HRBS or third parties as a result.
To exercise their rights, they may send the corresponding duly completed form, available on the website of the Spanish Data Protection Agency (“rights”), to Hotels & Resorts Blue Sea Management, S.L., C/ Gremi des Fusters 33, 07009 Palma de Mallorca, or to the email address dpo@blueseahotels.es, with the reference “Data Protection”.

If HRBS deems it necessary to identify customers, it may request a copy of a document proving their identity. In particular, regardless of the purpose or legal basis under which HRBS processes customer data, the latter have the following rights:

-Right of access: to obtain confirmation about what type of personal data we are processing, as well as access to it.
-Right of rectification: to request the modification of personal data when it is inaccurate or to have it completed when incomplete.
-Right of erasure: to request that personal data be deleted when, among other reasons, the data is no longer necessary for the purposes for which it was collected.
-Right of restriction: to request the restriction of data processing, in which case the data will only be kept for the exercise or defense of claims.
-Right to data portability: to receive personal data in a structured, commonly used, and machine-readable format, and to transmit it to another controller when processing is based on consent or a contract and carried out by automated means.
-Right to object: to object to personal data being processed based on the public or legitimate interest pursued by HRBS, including profiling, or to request the cessation of commercial communications.
-Automated individual decisions: to not be subject to a decision solely based on automated processing, including profiling, which produces legal effects or significantly affects the user. However, this right may not be exercised if the decision is necessary for the performance of a contract between the customer and HRBS; is authorized by applicable law to HRBS, provided adequate safeguards are in place; or is based on the customer’s explicit consent.
-Right to lodge a complaint: to lodge a complaint with the appropriate supervisory authority.

HRBS will process the Customer’s data at all times with absolute confidentiality and in compliance with the required duty of secrecy, in accordance with the applicable regulations, adopting the technical and organizational measures necessary to guarantee data security and prevent alteration, loss, or unauthorized processing or access, considering the state of the art, the nature of the data, and the risks to which they are exposed.

Purpose: At BLUESEA we process the information you provide us in order to render the contracted services consisting of booking accommodation in hotel establishments and sending you personalized offers regarding the company’s products and/or services, and managing the sending of information and commercial prospecting. We also process the information of our customers who have purchased our products and services in order to send them personalized offers regarding the company’s products and/or services. In order to offer you our products and services according to your interests, we will create a commercial profile based on the information provided. Automated decisions will not be made based on this profile. The personal data provided will be kept as long as your express consent is maintained and its deletion is not requested by the data subject, for a period of 5 years from the last contract and/or purchase made by you.

Legitimacy: The legal basis for processing your data is the execution of the contract through the purchase of the product and/or service in accordance with Law 34/2002 on Information Society Services, articles 20 and 21. The prospective offer of products and services is based on the consent requested, and in no case will the withdrawal of such consent condition the contract for the purchase and/or provision of service. It is mandatory to provide consent to manage the sending of information and commercial prospecting.

Recipients: No data will be transferred to third parties, except where legally required. There is no plan to transfer data to third countries. No decisions on adequacy, safeguards, binding corporate rules, or applicable specific situations are taken.

Rights: Any person has the right to obtain confirmation on whether Hotels & Resorts Blue Sea Management, S.L. is processing personal data concerning them. Data subjects have the right to access their personal data, as well as to request the rectification of inaccurate data or, where appropriate, request their deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected. In certain circumstances, data subjects may request the restriction of processing, in which case we will only retain the data for the exercise or defense of claims. You have the right to file a complaint before the Supervisory Authority (Spanish Data Protection Agency: WWW.AGPD.ES; source: THE DATA SUBJECT).

1.2. The customer expressly accepts the inclusion of personal data collected while browsing the website or provided through the completion of any form, as well as data derived from any possible commercial relationship, into the automated personal data files referred to in the first section. During the data collection process and at each location on the Website where personal data is requested, the customer will be informed, either by a hyperlink or by including the appropriate notices in the form itself, of the mandatory or optional nature of providing such personal data. Every customer who decides to register on our company’s website will be asked for the personal data necessary for the purposes of the requested service, which is none other than the provision of the services and/or sale of products offered on the Website.

1.3. The customer/user may exercise, in relation to the data collected as provided in the previous section, the rights recognized in Articles 15 to 21 of Regulation (EU) 2016/679, in particular the rights of access, rectification, deletion, restriction of processing, data portability, objection, and automated individual decisions, whenever applicable. The rights referred to in the preceding paragraph may be exercised by each customer through a rights-exercise form that they may request from us by email. 1.4. The automated processing to which all personal data collected as a result of the request, use, or contracting of any product or service or any transaction or operation carried out through this website will be subjected, has as its main purpose the maintenance of the contractual relationship with the owner of this website.

1.5. You authorize the sending of advertising regarding our services and products. Your personal data will be used to manage the sending of advertising by traditional or electronic means. The email addresses and personal data you provide through the website’s contact form will be used exclusively to respond to the inquiries you make. The provisions of Articles 22.1 and 22.2 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, apply, as amended by Article 4 of Royal Decree-Law 13/2012, regarding the use and processing of your personal data for the purpose of managing the sending of advertising.

1.6. The entity guarantees the confidentiality of personal data. However, the Company and/or Entity will disclose personal data and any other information in its possession or accessible through its systems to competent public authorities whenever required in accordance with applicable legal and regulatory provisions. Personal data may be kept in BLUESEA-owned files even after the relationships formalized through the company’s website have ended, exclusively for the purposes indicated above and, in all cases, for the legally established periods, available to administrative or judicial authorities.
