1.INTRODUCTION

This document aims to regulate the GENERAL TERMS AND CONDITIONS for the online booking services (hereinafter referred to interchangeably as the online booking services or the Services) of HOTELS & RESORTS BLUE SEA MANAGEMENT, S.L., and its subsidiaries listed in Annex 1, with registered office at Calle Gremi des Fusters 33, 2nd floor, office 23, 07009 Palma de Mallorca, established for an indefinite period and registered in the Commercial Registry of Palma de Mallorca, Volume 2544, Page 168, Sheet PM-72291, with tax ID B-57.81.72.15, (hereinafter, “BLUESEA” or “BLUESEA GROUP”), Tel. +34 971 427 110.
The terms "You" and "User" refer to all individuals and/or entities accessing www.blueseahotels.com or using the services for any reason.
Use of these services implies full and unconditional acceptance and validity of all the General Terms and/or Conditions—which will be automatically incorporated into the agreement signed with BLUESEA, without requiring a written transcription—contained in the most up-to-date version of these Terms and/or General Conditions.

2. USE OF BLUESEA'S ONLINE BOOKING SERVICES

2.1 Online Booking Services
a. The online booking services are intended for booking a room at any BLUESEA hotel. Using these services implies full and unconditional acceptance of all the General Terms and Conditions, which are automatically incorporated into the contract with BLUESEA, without requiring written transcription. This acceptance always refers to the latest version of these Terms and Conditions.
b. Booking procedure: When using the service, the user will receive a confirmation email stating that their booking request is being processed. If you are a consumer, once the corresponding charge has been made, you will receive a confirmation email that serves as proof of your reservation.
c. Guarantee: The booking is confirmed and guaranteed by credit card. In case of no-show without prior notice, the full stay will be charged (including VAT/IGIC and applicable taxes).
d. Contract termination or booking cancellation: The credit card is used solely as a guarantee. Cancellations made before the deadline set by each hotel (local time at the hotel) on the arrival day will not incur cancellation fees. After that, BLUESEA will charge the first night as a cancellation fee (including VAT/IGIC and applicable taxes). This clause does not apply to bookings made with special rates, where specific conditions apply.
e. BLUESEA hotels cancellation fees:
- The full amount will be charged for non-refundable bookings if cancelled.
- No-shows without prior notice will be charged 100% of the stay.
- For standard rate bookings, cancellations are free up to 7 days before arrival. Cancellations after that will be charged for the first night.
- For FLEX non-refundable rates, date changes are allowed with at least 7 days’ notice. The new rate applicable at the time of the change will apply.
These clauses do not apply to special rate bookings. In such cases, specific conditions will apply.
f. Minors policy:
Minors under 18 must be accompanied by parents, guardians or duly authorised adults. Hotel staff may request identification documents.
If minors participate in activities not supervised by hotel staff, the legal guardian is fully responsible for any damages the minor may cause or suffer.
g. Room and night prices:
Prices are only valid in writing and for the period specified. BLUESEA reserves the right to change rates without notice if justified. Booking prices will be shown during the booking process and include VAT/IGIC. Additional local taxes may apply and must be paid directly at the hotel.
h. Prices shown at booking include VAT/IGIC (or equivalent tax) based on the current rate. If the rate changes between the booking and the service date, the applicable rate will be the one in effect at the time of service, even if this results in a price increase.
2.2 Conditions for bookings made with BLUESEA:
• Payment is made in euros.
• Currency conversion is for information only and may vary.
• Some BLUESEA rates do not allow changes or cancellations.
• Tourist tax is not included.
• Pets are not allowed, except at BLUESEA Callao Garden.
Check-in at BLUESEA hotels (listed at https://www.blueseahotels.com/hoteles-bluesea) is between 2PM and 4PM. Check-out is between 10AM and 12PM.
2.3 The user agrees to use the services in accordance with current legislation, morality, good customs, public order, and these Terms and Conditions. The user must not use the services for illegal purposes, to infringe third-party rights or harm BLUESEA’s image.

2.4 BLUESEA may, for user convenience and improvement, unilaterally modify services or terms of use at any time without prior notice. Users may send suggestions to improve services by emailing: dpo@blueseahotels.es

3. DATA PROTECTION

This section provides information on how your data is processed in relation to bookings.

WHY AND FOR HOW LONG WILL BLUESEA PROCESS YOUR DATA?
We inform you that the data provided will be processed by BLUESEA for the following purposes:
- Manage the booking requested by the user.
- Send confirmation or documentation of the booking.
- If consent is given, send commercial communications from BLUESEA GROUP.
WHAT USER DATA WILL BLUESEA PROCESS?
To provide the services, BLUESEA will process the following data:
• Identification data: name, surname, nationality
• Contact data: email address, phone number
• Transaction data: booked products/services or shown interest
• Stay preferences
• Financial, banking or insurance data
• Other: any data provided voluntarily in open fields
Required data is necessary for the service; if not provided, the service cannot be delivered. If data of third parties is provided, the user confirms consent and responsibility to inform them of this privacy policy.
LEGAL BASIS FOR DATA PROCESSING
The legal basis for processing is the execution of the contract. For commercial communication, it is the user's consent. Users may withdraw consent at any time without affecting the lawfulness of processing prior to withdrawal.

WHO WILL YOUR DATA BE SHARED WITH?
Data may be shared with:
• BLUESEA Group companies involved in providing the booked services
• Hotel property owners, some of which may be outside the EEA (including non-adequate countries) for service provision purposes only.
DATA RETENTION
Personal data will be kept during the contractual relationship and for the legal limitation period thereafter. For marketing communications, data will be retained until the user withdraws consent.
THIRD-PARTY DATA PROCESSING
If users provide third-party data, they confirm they have the necessary consent and will inform BLUESEA of any updates.
USER RIGHTS
Users can exercise their rights at any time by contacting dpo@blueseahotels.es (Subject: “Data Protection”) and attaching a copy of their ID:
1. Revoke consent

3. Access personal data
4. Rectify inaccurate or incomplete data
5. Request deletion of unnecessary data

4. CORRECT USE OF WEBSITE CONTENT BY THE USER

4.1 BLUESEA declares that the industrial property rights (trademarks, trade names, etc.) appearing on this website are its property and/or are lawfully used under agreements or licenses, and are duly protected by applicable industrial property laws. The User agrees to use the website diligently, correctly, and lawfully and, in particular, commits to refraining from the following actions:
a) Removing, bypassing or altering the copyright, trademarks, and other identifying information of BLUESEA or third-party rights included in the website content, as well as technical protection devices or any information mechanisms.
b) Using the content, and especially BLUESEA’s information obtained from the website, to send advertising, direct sales messages or any other commercial communication, or unsolicited mass messages.
c) Reproducing, copying, distributing, publicly communicating, transforming or modifying the content, unless expressly authorized by the holder of the corresponding rights or legally permitted.
d) Using the content in any way that is illegal, immoral, against generally accepted good practices or public order. BLUESEA does not grant any license or authorization for the use of its industrial and intellectual property rights or any other rights associated with its website.

4.2 Procedure in case of intellectual property rights violation: If any user or third party believes that any content on this website infringes their intellectual property rights, they must notify BLUESEA, providing full and accurate information about themselves, the allegedly infringed rights, and the specific website content in question.

5. RIGHT TO MODIFY THE GENERAL TERMS AND CONDITIONS OF CONTRACT

BLUESEA reserves the right to unilaterally modify these General Terms and/or Conditions of Contract at any time. Users will be informed of any modifications through www.blueseahotels.com.

6. DISCLAIMER OF WARRANTIES AND LIABILITY

6.1 BLUESEA does not guarantee the reliability, availability or continuity of the services made available to the user, and therefore excludes any liability for damages that may arise due to the lack of availability, reliability or continuity of its website or services. Nevertheless, BLUESEA will strive, as far as possible, to offer technical support to the affected party and to restore service promptly using alternative solutions where feasible.

6.2 BLUESEA is not obligated to check, and does not check in advance, for viruses or other elements in its content that may cause alterations in the user’s software or hardware. Therefore, it shall not be held liable for any damage resulting from such elements.

6.3 If, despite all due care and diligence, BLUESEA is unable to provide the booked rooms due to reasons beyond its control, and is unable to deliver the agreed services, the user will be offered either a full refund or an alternative of similar category or quality. If the alternative is of a lower standard, BLUESEA will refund the difference.

7. SEVERABILITY OF GENERAL TERMS AND CONDITIONS OF CONTRACT

If any clause of these General Terms and/or Conditions of Contract is declared null or unenforceable, the remaining clauses will remain valid. BLUESEA commits to replacing any invalid clause with one that closely reflects the original intention of the parties. No clause in this contract shall affect mandatory consumer protection rights. If you are not a consumer, you expressly waive your right of withdrawal.

8. WWW.BLUESEAHOTELS.COM AND ACCEPTANCE OF TERMS OF USE

By using the online reservation services, the user fully and unreservedly accepts the Terms of Use of www.blueseahotels.com, as published by BLUESEA at the time of reservation. These terms complement the present General Terms unless they contradict them. Users should review the website’s rules before accessing or using these services.

9. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions of Contract are governed by Spanish law. In case of any dispute regarding their validity, execution, or interpretation, both BLUESEA and the user agree to submit to the Courts and Tribunals of Palma de Mallorca, waiving any other jurisdiction. This contract constitutes the entire agreement between BLUESEA and the user and supersedes all prior verbal or written agreements.
In any case, any dispute arising from hotel service provision shall be submitted to consumer courts.

MODIFICATIONS

The company reserves the right to unilaterally modify these conditions at any time without prior notice. Changes will be published and communicated as early as possible. The company also reserves the right to modify the website’s presentation and layout without notice.

THIRD-PARTY LINKS

This Legal Notice applies only to this website and its content, not to third-party links or external websites accessible from it. The company is not responsible for the content of linked pages or for any link on those sites.

INTELLECTUAL AND INDUSTRIAL PROPERTY

All content on this website is the exclusive property of the company, including but not limited to graphic design, source code, logos, texts, graphics, illustrations, photos, and other elements. Likewise, all trade names, trademarks, or distinctive signs on the website are protected by intellectual and industrial property laws. The company holds exclusive rights to use and exploit such content, especially reproduction, distribution, and public communication rights. Unauthorized use of all or part of the website’s content is prohibited. The company reserves the right to take legal action against any user who reproduces, distributes, commercializes, transforms or otherwise exploits all or part of the content, infringing intellectual or industrial property rights.

For the purposes of these General Conditions, and for any necessary communication between the entity and the User, correspondence must be sent via email to reservas@blueseahotels.com. Communications from the entity will be sent using the data provided by the user when registering at www.blueseahotels.com. The User expressly accepts the use of email for all communication related to the website and contracted services.

APPLICABLE LAW AND JURISDICTION

These conditions shall be governed by Spanish law. For all matters not expressly regulated herein regarding interpretation, validity and execution, the parties submit to the Courts and Tribunals of Palma de Mallorca, expressly waiving any other jurisdiction.
